TLDR
We sell you a licence to run our CLI. You pay monthly. You can cancel anytime. We don’t see your code. 008 fails open — a broken tunnel never blocks your agent.

Parties
These terms are between you (“Customer”) and Ipenga Consulting, a sole proprietorship registered in the Republic of South Africa (“Ipenga”, “we”). 008 (also known as 008_TACTICAL) is an Ipenga Consulting product.

What you get
A licence to run the 008-cli Node.js tool on the number of devices specified by your plan (Solo = 1, Pro = up to 5). The licence is non-exclusive, non-transferable, and revocable on the terms below. We provide the license-validation server, the phone PWA at 008-pwa.vercel.app, and Web Push delivery for approval prompts.

Billing & cancellation
- Billing is monthly, in advance, in USD via Stripe.
- You may cancel at any time from your Stripe-managed subscription portal. Cancellation takes effect at the end of the current billing period.
- A 14-day free trial is available without payment details and is the effective refund window — see Refunds.

Refunds
Because we offer a free 14-day trial on all paid plans, we do not offer refunds on completed billing periods. If the service is materially broken for > 24 h and we cannot restore it in a reasonable time, email carl@ipengaconsulting.com and we will pro-rate that month.

What you may not do
- Redistribute or resell your licence key.
- Reverse-engineer or modify the licence-validation logic to bypass payment.
- Use 008 to gate agents you do not own or operate, or in a way that violates the law of your jurisdiction.
- Use 008 to facilitate unauthorised access to third-party systems.

What we may not do
- See, store, or share the content of your agent commands. Hook traffic flows over your own Cloudflare Tunnel.
- Sell your email or contact you for anything other than billing, security, or service-affecting issues.
- Change pricing on you mid-subscription without 14 days’ notice.

Service availability
008 is provided on a best-effort basis. The local server, hook script, and cloudflared tunnel run on your machine — outages there are not our doing. Our public services (license API, PWA hosting, Web Push) target 99.5% monthly availability but carry no SLA. If our license server is unreachable, the CLI offers a 7-day offline grace before refusing to start. Hook calls always fail open: if the tunnel or your phone is down, your Cursor agent is never blocked by 008.

Liability
008 sits in front of an AI agent. We do not warrant that approvals or denials prevent every category of damage an agent could cause. To the maximum extent permitted by law, our total liability to you is limited to the amount you paid us in the 3 months before the claim arose.
TOS_09
Termination
We may terminate your licence for breach of these terms (e.g. abuse, chargebacks, redistribution) on 7 days’ notice. You may terminate at any time by cancelling in Stripe.

Governing law
These terms are governed by the laws of the Republic of South Africa. Disputes are resolved in the courts of Cape Town, Western Cape.
